Terms of service

Effective date: 18 October 2026

These terms are an agreement between you and Version Phi, of Lagos State, Nigeria ("we", "us"), which operates Merge X. By using Merge X you agree to them. If you don't agree, please don't use it. Our privacy policy explains how we handle data.

1. Who can use Merge X

You must be 18 or over and have a Google account. You must also follow Google's terms for your account, including Gmail's program policies. If you use Merge X for an organisation, you confirm you are allowed to accept these terms for it.

2. The service

Merge X sends personalised emails from your own Gmail account to the people in a Google Sheet. It is free. Emails include a short Merge X footer, which you can turn off in settings. Merge X is new and still changing: features may change or stop, and we may set limits to keep the service running within its free resources.

3. Anti-spam rules

You may only email people who agreed to hear from you or who have a real relationship with you. You must not:

• send to bought, rented, shared or scraped lists;
• remove, hide or ignore unsubscribe links, or email people who unsubscribed;
• send content that is unlawful, deceptive, threatening or harassing, or that contains phishing, malware or false sender details;
• try to get around Gmail's sending limits or ours, for example by spreading one campaign across several accounts;
• use Merge X in a way that breaks anti-spam or data protection laws where you or your recipients are.

You are responsible for the emails you send, for the content of your sheets and templates, and for having a lawful reason to use your recipients' data.

4. Your Google account

Emails are sent through Gmail with your permission, so Google's limits and decisions apply. Google may limit or suspend your account if it sees spam or abuse; we can't control or reverse that. Sending too much, or to people who don't want your emails, can harm your account and your domain's reputation.

5. Your content

You keep all rights to your sheets, templates and other content. You allow us to store and process it only as needed to run Merge X for you.

6. Suspension and ending

You can stop using Merge X and delete your account at any time. We may pause campaigns, limit, suspend or close an account that breaks these terms, puts the service or other users at risk, or where the law requires. Where reasonable, we will tell you why.

7. No warranty

Merge X is provided "as is" and "as available". We don't promise it will be uninterrupted or free of errors, or that every email will be delivered. Email can be delayed, filtered as spam or rejected by the receiving server.

8. Limitation of liability

To the extent the law allows, we are not liable for indirect or consequential losses, lost profits, lost data, or damage to your account or reputation from using Merge X. Our total liability for any claim is limited to the amount you paid us for Merge X in the 12 months before the claim. Nothing in these terms limits liability that the law does not allow us to limit.

9. Governing law

These terms are governed by the laws of Lagos State and the Federal Republic of Nigeria. The courts of Lagos State have jurisdiction over any dispute, unless the law where you live gives you the right to bring a claim there.

10. Changes to these terms

We will post any change on this page and update the effective date. If a change matters, we will also tell you in the app or by email before it applies. Using Merge X after a change takes effect means you accept it.
